Judicial Verdict on 10 March: Appeal and Update on Justice for Maruti Workers

Dear Comrades,

We are writing with an appeal, and update on the legal case. The Maruti Suzuki workers case (‘State of Haryana vs Jiyalal & Others’) is going on since July 2012 through a maze of evidence-less lies and clear pro-corporate anti-worker intent. Since 2012, 216 workers face possible convictions by a pro-corporate system, besides the terminations (and labour cases) of 546 permanent workers and 1800 contract workers, and a separate case of offences against 111 more workers in Kaithal since 2013.


The date for the Judgment from the Trial Court, the Gurgaon Additional District and Sessions Court, has been set for 10th March 2017. We are apprehensive and have grounds to believe that it will be a politically motivated anti-worker Judgement. The hand-shaking between the Maruti Suzuki company management and the Police, administration, the government and Judiciary could not be more clear as in this case. We are apprehensive about a Pricol-type ‘life sentences’ and long-term convictions against hundreds of workers and are preparing with a call for unity of all workers and all pro-worker forces. We appeal to you from the Provisional Working Committee, Maruti Suzuki Workers Union to be present in the Gurgaon Sessions Court premises on the day of the Judgement in the case on the 10th of March. We also appeal to you to be united and take solidarity actions in support of Justice for all Maruti Suzuki workers facing repression by the Central and State Government and the Company.


Today, 25000 workers in several factories (permanent-contract-apprentice as well as safai karamcharis) in Gurgaon-Manesar have boycotted lunch today in show of unity and solidarity with the Jailed Maruti Suzuki workers, and warning the organised capitalist class against any anti-worker Judgement tomorrow 10th March by the Gurgaon CourtThese include workers of 4 plants of Maruti Suzuki, FMI and Bellsonica among others. Day before, workers in several factories gave warning letters to the managements and to the Labour and local administration in solidarity with jailed Maruti workers, and notices for lunch boycott, and gate meetings in factories by thousands of workers.

Update on the Legal Case as it Stands during the Final Arguments:

Context: We had 3 strikes in 2011 where we raised voice against the system of exploitation in the factory, and had to face continued management attacks on our Trade Union rights with complicity of the administration. We finally formed our Union – Maruti Suzuki Workers Union, Manesar (Reg. No.1923) on 1 March 2012. In April, we submitted their Charter of Demands, where the Union said abolition of contract worker system as one of its central demands, among others. This kind of assertion of our rights against their exploitation was not being taken lightly by the Company management, as it challenged their power and profits. They wanted to attack the Union through their power and conspiracy, which resulted in the incident on 18 July 2012, of a clash inside the plant and the death of an HR manager. Since then, 147 workers have been in Jail without having got bail for more than 3-and-a-half years on charges ranging from murder, attempt to murder, rioting, looting, setting fire to private property and various Sections of the IPC. Currently, 11 workers continue to be in jail without bail, which includes the members of the then Union Body. 66 more workers other than the 147 have similar charges under various non-bailable sections. Along with this criminalization of labour, 546 permanent and 1800 contract workers were terminated from their jobs, whose labour cases are also ongoing. 2500 working class families faced constant repression and penury on top of exploitation of the workers in the factory which created the basis for the management-labour conflict. We have had a movement against this regime of exploitation and repression till today.


The final legal arguments in the Maruti Suzuki workers Trial case concluded on 18 February, 2017 with arguments by Advocates Vrinda Grover, Rebecca John and RS Cheema against the State Prosecution. Find here some facts on the case as it stands in the Courts:


1.      It was established during the final arguments that there is no direct evidence linking ‘murder’ or ‘setting fire’ to the factory on any worker. No prosecution witness could establish any worker involvement in the same. Neither was any CCTV footage produced by the Prosecution even after Defence asked for the same. The management person Deepak Anand from GM Vigilance who filed the FIR against the 55 Maruti workers named therein, could not identify any worker. The witness Salil Vihari who named the main accused Jiyalal, could not identify him.


2.      On 18 July 2012, the incident of conflict happened at 7.20pm. But Police was called by the Company management at 11am itself, but Police was not allowed inside until the entire incident came to a boil. It has already been said by workers that it was a pre-planned conspiracy on behalf of the management so that a conflict is generated and workers can be implicated on this basis. Bouncers in workers clothes were also brought inside in the morning itself without IDs.


3.      The FIR mentions that 400–500 workers with rods, batons and sticks in hand entered the HR and beat the management but no witness mentions these weapons. Instead all the witness uniformly said that workers were carrying shockers and door beams – each doorbeam and shocker weighing over 4kgs, so around 4000kgs of weapons were supposedly recovered. On top of this, Police show that a major section of workers took all these weapons to their respective homes and kept them under their beds and almirahs. For another set of workers, Police showed that they caught 20 workers simultaneously siting under a tree conveniently possessing all these weapons.


4.   Also, witnesses had said that each manager was beaten up by 4-5 workers with these weapons with intention of murder. The also stated that no one came to rescue them. But if this was so, then how did they manage to rescue themselves with no serious injury? To this, they said that the workers themselves let them off, which clearly is no intention to murder! The witnesses testified that all of them uniformly stopped the attacks with their left hand. In the MLC done on management injuries show absurdities as a dental root canal as injury!


5.      It has been established how 89 of the 147 workers have been arrested on the basis of names given alphabetically by 4 contractors. None of these workers were identified. Court documents show witness Virendra alias Rajender Yadav has named 25 workers such that all workers’ names fall in the alphabetical range of A-G. Another witness contractor Yaad Ram testified that he saw 25 workers rioting, all of whose names fall in the next range G-P. Witness Ashok Rana names 26 workers who were allegedly rioting whose names range from P-S. The final witness Rakesh of Tirupati Associates who supplied 900 contract workers to MSIL testified to allegedly seeing 13 workers whose names, continuing the alphabetic sequence, are in the range S-Y.


6.      The lists of workers arrested thus was provided by the Company to the Police, and not on the basis of its own investigation, pointing to an active collusion between the two.


7.      On ‘setting fire to the factory’:  There was no evidence whatsoever as to setting fire and no witness could explain how the fire was lit and who did it. First, there were contradictory statements as to where the fire was lit – in the conference (M1) room in the first floor, or outside it, or in the ground floor. Awanish Dev’s dead body was recovered from the M1 room, and the witnesses claimed that the room was lit on fire from inside where fighting was taking place, but while testifying they argued that the room caught fire from the outside.


Fire lit and burnt everything down but the match box (a new one) was conveniently unharmed and lying there to be discovered. This recovery of the match box itself was not immediate. At the place of the incident, when the security on-watch, Om Prakash, went on 19th July 2012 in the morning at 6 am, to the M1 store with a photographer nothing was recovered. Then on that very day at 12 pm FSL authority D. Sonu searched and recovered a new match box and a door frame, and where the room was entirely burnt there was no sign of the matches itself being lit. He neither signed the recovery report nor did he testify in court on the recovered matches and door beam.


On the setting of fire inside the M1 room, of the 16 witnesses that had stated that the room was lit on fire, and 3 witnesses took names of those who did it. None of these witnesses could identify any worker or wrongly identified.


8.      According to the postmortem report, Awanish Dev’s death was due to asphyxiation. The injury he had is below the knee on the right leg, which cannot lead to death which proves that neither is there a murder case possible against the workers nor is their intention to murder in this case. So Sections 302 (murder) and 307 (attempt to murder) clearly do not hold. At max, only 2 people can cause such an injury, while 216 workers have been accused of murder and attempt to murder.


Thus even though this is, on the face of it, pertaining to the case on 18 July 2012 where a general manager of the company Awanish Kumar Dev died in the conflict that erupted that day after a Dalit worker Jiyalal was suspended from duty unilaterally when a supervisor attacked him and gave casteist abuse. But as is evident by now, it was a conspiracy from the management against assertion of workers for our Trade Union rights.


Even so, the considerations of the Judiciary are suspect as is evident from one of the High Court orders in May 2013 rejecting bail said “this is one one of the unfortunate incident that has lowered the reputation of India in the world. Foreign direct investment is likely not to happen due to fear of growing labour unrest”. The State has already spent crores of public money all these years against the workers. As per RTIthe government paid Advocate KTS Tulsi R.5.5 crore in just 2 years – s. 11 lakh per appearance – just in the Gurgaon Additional District and Sessions Court, Mr Tulsi’s three assistants Rs. 66000 for each appearance and “clerkage” of over Rs. 1 lakh for his expenses each appearance. If this was not enough, instead of the Public Prosecutor from the State, Private Prosecutor from the Company, Vikas Pahwa again kept the ‘last word’ on their behalf in the Sessions Court Gurgaon during the final arguments.


Will there be Justice for Maruti Workers?

The 147 workers who have spent over four years in Jail, and 11 who continue to be jailed without bail since July 2012, the total implicated 216, the 2500 families, those who have lost their family members in that course of time or not been able to see their children grow up for those years or have not been able to part of the joys and sorrows of their family for that time – will there be justice?


In this industrial belt, workers struggle have happened from Rico Gurgaon (2009) to Shriram Pistons Bhiwadi (2014) to Honda Tapukhera (2016) and countless others against regime of exploitation on workers by the profit-hungry MNCs. Management. In all these cases, to control the simmering tension, there have been outright repression through terminations, violence, murders, lathi-charges, false criminal cases and prison terms by the Police-administration-government and local goons on the company’s payrolls. In current workers struggles, while the management says, “we will make Maruti-like situation for you” (repress you like the Maruti workers), the workers also say right back, “This can turn into a Maruti-like situation” (Workers will wage a collective movement relentlessly against exploitation-repression). We say this will be a ‘political judgement’ since this judgement becomes a measure and signal of which version of ‘maruti-like situation’ stands.


On 1st March 2017, we marked 6 years of the formation of our Union with a gate meeting in front ofthe factory in Manesar, where thousands of workers and Unions participated. After this,  the company has moved a stay order against 10 terminated workers in the leadership of the Provisional Working Committee, MSWU to stay 2kms away from the company gate. On 7th March, various Unions met in Gurgaon and resolved to hold factory gate meetings and give warning letters to their managements in solidarity with Jailed workers which happened on 8th March. There is lunch and dinner Boycott in various factories on 9th March. Hundreds of workers will gather in the Court premises at 10am and in the afternoon on 10th March.


We appeal to you to be united and resist this onslaught by capitalists and the government, and stand with the workers class movement in this crucial and decisive situationWe appeal to you from the Provisional Working Committee, Maruti Suzuki Workers Union to be present in the Gurgaon Sessions Court premises on the day of the Judgement in the case on the 10th of March. We also appeal to you to take solidarity actions in support of Justice for all Maruti Suzuki workers facing repression by the Central and State Government and the Company.

Appeal to Strengthen Campaign for JUSTICE for Maruti Suzuki Workers !

As you know, since 18th July 2012 in the Maruti factory in Manesar-Haryana-India, as per the nexus of management-police-administration-government, we have had to face the heavy hand of injustice and repression, which continues to this day. 215 of our fellow workers have baseless fabricated cases on them, 147 workers have been jailed, 2300 workers have had their jobs terminated including 546 permanent workers. Today, more than three years later, 35 workers continue to languish in jail without bail. The last stages of debate on the trial is approaching. The company management and state are in full preparation to set an example by handing the harshest sentence on workers, so that workers fear to raise their voices in struggle.

The state is keen to show its commitment to the interests of national-international capital, by clearing all ‘bottlenecks’ to the logic of their business, by crushing all resistance put up by workers who make and suffer this senseless model of development. The pro-corporate changes in labour laws to the repression of Maruti workers are sides of the same coin. So the Maruti Suzuki workers who languish in jail for more than three years without any semblance of concrete proof of their ‘guilt’ are political prisoners in the conflict between the class of owners and the working class. This is the reason that workers of Orient Craft and Graziano have to be behind bars for years on end. And this is the reason that the Judge in the Chandigarh High Court has to say that ‘the bail of Maruti workers will affect foreign investment’. In such a scenario, all pro-worker forces and individuals will again have to come together against this conspiracy of power.

As the last debate in the Trial Court in Gurgaon approaches, we have decided to undertake ‘Campaign for Justice’ in various parts of the country to expose this unholy nexus of the company management and the State. It is with your solidarity till date that our struggle has seen this long mile. It is our appeal that you again participate and take this campaign up in whatever capacities and ways possible. It is our appeal that you organize programs in your own cities and localities with various pro-worker and pro-people forces, in which we would also come and participate.

Towards the end of this campaign, on 27th November 2015, come and attend the ‘Workers Justice Convention’ in Gurgaon and make the program successful and a marker of continued and strengthening united resolve of forces struggling against state-corporate nexus.

हड़ताल! 2 सितम्बर 2015: सरकार की मज़दूर-विरोधी गतिविधियों के खिलाफ. .

मोदी सरकार बड़े पूंजीपतियों के हितों को आगे बढ़ाने के लिए देश के मज़दूर वर्ग पर एक कटु आघात चला रही है| मज़दूरों के यूनियन बनाने, हड़ताल करने, स्थायी और सुरक्षित नौकरियां पाने और यहाँ तक कि न्यूनतम मज़दूरी पा कर एक सम्मानजनक जीवन जीने के अधिकारों को दरकिनार करने के लिए मज़दूर विरोधी श्रम कानून सुधारों को लागू किया जा रहा है| इन मज़दूर विरोधी हमलों के खिलाफ सभी केन्द्रीय ट्रेड यूनियनों द्वारा अखिल भारतीय मज़दूर हड़ताल की संयुक्त घोषणा की गयी है|

इस संदर्भ में मारुती सुजुकी वर्कर्स यूनियन (मानेसर प्लांट), मारुती सुजुकी कामगार यूनियन (गुड़गांव प्लांट), मारुती सुजुकी पॉवरट्रेन इंडिया एमप्लोयीज़ यूनियन (इंजन प्लांट) और सुजुकी मोटरसाईकिल इंडिया एमप्लोयीज़ यूनियन (बाइक प्लांट) ने ‘मारुती सुजुकी मज़दूर संघ’ के बैनर के अंतर्गत संयुक्त रूप से उत्पादन रोकने और 2 सितम्बर की हड़ताल में शामिल होने का फैसला किया है| प्रबंधन को पहले से ही स्ट्राइक नोटिस दिया जा चूका है| मारुती यूनियनों ने गुड़गांव-मानेसर-धारूहेड़ा-बावल औद्योगिक क्षेत्र में सभी यूनियनों के बीच हड़ताल में शामिल होने की सर्वसहमति बनाने में भी एक महत्वपूर्ण भूमिका निभाई है| हम इस पहलकदमी के लिए उन्हें बधाई देते हैं|

यह कदम कई कारणों से महत्वपूर्ण है| 18 जुलाई 2012 के बाद मारुती सुजुकी, खासकर मानेसर प्लांट के मज़दूरों ने प्रबंधन, प्रशासन, पुलिस और न्यायालयों के हाथों कड़े आघात और दमन का सामना किया है| 148 मज़दूर ज़मानत के बिना करीब तीन साल तक जेल की सज़ा काटते रहे| इनमें से 35 साथी अब तक जेल में हैं और उच्च न्यायालय ने हाल ही में इनमें से दो की ज़मानत की अपील ख़ारिज की है| अन्य 64 मज़दूरों के खिलाफ़ गैर-ज़मानती वारंट हैं और इन्हें भगोड़ा घोषित कर रखा है| पुलिस अब तक उनके पीछे पड़ी है| 423 स्थायी मज़दूर, 123 ट्रेनी मज़दूर, और 1800 ठेका मज़दूर बिना किसी जांच के कम्पनी से निकाल दिए गए हैं| मज़दूरों को IMT मानेसर इलाके में शांतिपूर्ण विरोध प्रदर्शन करने की इजाज़त तक नहीं दी गयी| अंदर काम कर रहे मज़दूरों को बंदूक की नोख पर काम करने को मजबूर किया गया और करीब 2 साल तक कोई यूनियन गतिविधि जारी करने की इजाज़त नहीं दी गयी| किन्तु, बाहर हुए मज़दूरों ने सभी कठिनाइयों का सामना करते हुए भी आज तक अपने संघर्ष को जारी रखा है, और अंदर काम कर रहे मज़दूरों ने इस दमन का जम कर मुकाबला करते हुए यूनियन गतिविधियों को पुनः जारी किया है और बाहर हुए और जेल में बंद संघर्षरत मज़दूरों का समर्थन करते रहे हैं| यह हड़ताल दमन और संघर्ष के ऐसे ही माहौल में होने वाली है|

हम अपने संघर्ष को, या हम पर हो रहे दमन को गुड़गांव-मानेसर-धारूहेड़ा-बावल-नीमराना-भिवाड़ी क्षेत्र के मज़दूर वर्ग के संघर्षों से, श्रीराम पिस्टन, डाईकिन, मिंडा, बैक्सटर, मुंजाल किरिऊ, पौस्को, औटोफिट, हीरो मोटोकोर्प, अस्ति, ताल्ब्रोस, औटोलिव, नपिनो ऑटो, JNS, बजाज मोटर्स, ओरिएंट क्राफ्ट, ऋचा गारमेंट्स इत्यादि में (पिछले तीन सालों में हुए) संघर्षों से, व हमारे देश के संगठित और असंगठित मज़दूरों और उनके प्रतिरोध से अलगाव में नहीं देखते हैं| यह हड़ताल दमन और शोषण के इस तंत्र के खिलाफ संघर्ष करने के हमारे सामूहिक संकल्प की छवि है|
आइये, हम 2 सितम्बर की इस हड़ताल को बड़ी सफलता तक ले जाए और सरकार की मज़दूर-विरोधी गतिविधियों का मुहतोड़ जवाब दें|

Hadtal! Joining the all-India STRIKE on 2nd September 2015

Dear Comrade

The Modi government is unleashing a severe attack on the working class of the country to serve the interests of big capitalists. Anti-worker labour law reforms are being implemented to scuttle the rights of the workers to form union, to strike, to get permanent and secured jobs and to get even the minimum wage to have a life of dignity. Against this anti-worker offensive, there is a joint call of All-India Workers Strike from all Central Trade Unions.

In this context, Maruti Suzuki Workers Union (Manesar plant), Maruti Suzuki Kamgar Union (Gurgaon plant), Maruti Suzuki Powertrain India Employees Union (Engine plant) and Suzuki Motorcycle India Employees Union (Bike plant), under the banner of ‘Maruti Suzuki Mazdoor Sangh’ have collectively decided to stop production and join the strike on 2nd September. The strike notice has been served to the management already. The Maruti unions have also had a key role in the Gurgaon-Manesar-Dharuhera-Bawal industrial belt to help reach a unanimous decision by all the unions to go on strike on that day. We congratulate them for these initiatives.

This is a significant step because of many reasons. After 18 July 2012, the workers of Maruti Suzuki, particularly of Manesar plant, have faced severe attack and repression by the management, the administration, the police and the court. 148 workers were in jail without bail for almost three years. Till now 35 are still in jail and the High Court has rejected the bail petition of two among them recently. 64 more have non-bailable warrants against them and are declared ‘absconding’. Police is still now haunting them. 423 permanent workers, 123 trainees and 1800 contract workers were thrown out of the factory without any enquiry. The workers were even not allowed to organize any protests in the IMT Manesar area. The workers who remained inside were forced to work at gunpoint and were not allowed to have any union activity for almost 2 years. However, the workers outside have continued their struggle against all odds till date, and the workers inside have fought back, have resumed union activities and have extended support to the struggling workers who are outside the plants and in jail. In this atmosphere of repression and struggle, the strike is going to take place!

We do not see our struggle or the repression against us in isolation from the larger attack on the working class of Gurgaon-Manesar-Dharuhera-Bawal-Neemrana-Bhiwadi belt, from the struggles in Shriram Piston, Daikin, Minda, Baxter, Munjal Kiriu, Posco, Autofit, Hero MotoCorp, Asti, Talbrose, Autoliv, Napino Auto, JNS, Bajaj Motors, Orient Craft, Richa garments etc (which have taken place in last three years) and the organized and unorganized workers of our country and their fightback.
The strike is a reflection of collective resolute to struggle against this regime of opression and exploitation!

Let us make the 2nd September strike a huge success to give a fitting reply to the anti-worker activities by the Government !

आज दोपहर 3 बजे मानेसर में मारुति सुजुकी कंपनी गेट के सामने हमारी गेट मीटिंग संपन्न हुई| इस साथ हमने अपना यूनियन बनाने का अधिकार और हम मजदूरों की सामूहिक शक्ति को दोबारा स्थापित किया| लगभग 3000 मजदूर इस गेट मीटिंग में शामिल हुए जिसमे इसको नई मारुति सुजुकी वर्कर्स यूनियन (MSWU) सदस्यों के साथ सुजुकी पावरट्रेन इंडिया एम्प्लोयिज़ यूनियन (SPIEU) व सुजकी मोटरसाइकिल इंडिया एम्प्लोयिज़ यूनियन (SMIEU) के मजदूर ने अपनी बात रखी| MSWU के नए सदस्यों ने कहा कि प्रबंधन को द्वेष की भावना को छोड़, संघर्षरत मजदूरों के मांगो के ऊपर ध्यान देना चाहिए| ताकत की एक लहर ने घोषणा की कि डर के राज को हमने ख़तम किया जिसको मालिक-प्रबंधन ने हम पर थोपा था| 4अप्रेल के चुनाव और यूनियन के पुनर्गठन के बाद, आज की सभा ने हमारे शोषण-दमन के खिलाफ़ अथक संगर्ष को कायम रखने का एलान किया|

हमने 4अप्रेल के यूनियन चुनाव में 12 में से 11 सिटो पर तथा 80% के मार्जिन से प्रबंधन के द्वारा कठपुतली पैनल के खिलाफ जीत हासिल की| प्रोविजोनल वर्किंग कमेटी, MSWU के कामरेड रामनिवास ने कहा कि “यह पिछले दो साल कंपनी प्रबंधन-सरकार-प्रशासन-पुलिस की मिलिभगत से चलायी गयी शोषण-दमन के चक्र के खिलाफ जीत हैं|” यह जीत 4जून 2011 से चले आ रहे संघर्ष का ही नहीं, बल्कि खासकर 18जुलाई 2012 से चले अथक संघर्ष का नतीजा हैं| 20 महीने से ज्यादा हो चुका है कि 147 मजदूर आज भी जेल की सलाखों के पीछे कैद है, जिनकी अभी तक ज़मानत भी नहीं हुई हैं| यह भारत के अपराधिक क़ानूनी व्यवस्था के ऊपर एक काला धब्बा है| 546 पक्के मजदूरों के साथ 1800 ठेका मजदूर को बिना जांच नौकरी से निकाल दिया गया है, जो आज बेरोजगार है| हमारे अधिकारों को कुचलने के लिए कंपनी मालिक-प्रबंधन-सरकार-पुलिस सहित पुरी व्यवस्था आज एकजुट है, की “मजदूरों को एक सबक सिखाया जाए”| यह तक की कोर्ट ने भी हमे “विदेशी पूंजी निवेश को घटा पहुचाने” के जुर्म के लिए दोषी ठेहेराया| हमने तो बस मजदूर के बतौर अपने सम्मान, यूनियन बनाने का अधिकार, व ठेका मजदूरों के अधिकार की मांग की| पिछले दो साल में हमने जेल में बंद सभी मजदूरों को रिहा करने, सभी बर्खास्त मजदूरों को काम पर वापस लेने और त्रिपक्षीय समझौते की मांग की| और इन मांगो के लिए, हमने अपनी एकता कायम रखने की जुर्रत की|

मारुति प्रबंधन ने इस चुनाव में मजदूरों को डरा धमका कर, पुरे प्रक्रिया को अपने हित में मोड़ने की कोशिश की| उसने हर तरीके के षड्यंत्र से पक्के और ठेका में, विभिन्न इलाको में, विभिन्न प्लांटो में, मजदूरों की एकता तोड़ने की कोशिश की| 2300 मजदूरों को बेरोजगार करने के बाद, प्रबंधन ने डर और दंड का ऐसा माहौल तय्यार किया जिससे नए मजदूर उससे दबकर रहे| इन नए मजदूरों को निकाले गए मजदूरों और संघर्षरत मजदूरों व युनिअनो के साथ बात तक करने की इजाजत नहीं थी| उन्होंने अपने पक्षपाती 250 मजदूरों का गुडगाँव प्लांट से मानेसर प्लांट में तबादला किया| उन्होंने जेल में बंद व बर्खास्त मजदूरों को यूनियन के संविधान के विपरीत मताधिकार के वंचित करने का पूरा प्रयास किया, जिसका श्रम विभाग ने अनुसरण किया| किसी भी मजदूर ने अगर इसके खिलाफ पर्चा बाटने की कोशिश की, उसको पुलिस के द्वारा प्रताडि़त किया गया| और चुनाव में अपने चहेते उमीदवार खड़े कर दिए और मजदूरों को पूरी तरह दबाने की कोशिश की|

इन फुट डालो- राज करो, दमन और भय की नीतियों के बावजूद हम कामयाब हुए| जेल में बंद और बर्खास्त मजदूरों के जोरदार समर्थन और सहयोग से, संघर्षरत मजदूर 12 में से 11 सिट जीते| 4अप्रेल की शाम एक एसी शाम थी जब मजदूरों ने फेक्टरी में फिर से अपना हक़ हासिल किया| दो साल बाद, फेक्ट्री के सामने सड़क पर फिर से ख़ुशी और जश का माहौल था| नारा लगाते हुए अन्दर कार्यरत मजदूर अपनी कंटीन से बर्खास्त मजदूरों के लिए खाना लेकर बाहर आए, और उन्होंने कहा कि अभी संघर्ष ख़तम नहीं हुआ हैं, जब तक बर्खास्त और गिरफ्तार साथीयों का संघर्ष पूरा नहीं होता|

यहा सुजुकी पावरट्रेन इंडिया एम्प्लोयिज़ यूनियन (SPIEU) व सुजकी मोटरसाइकिल इंडिया एम्प्लोयिज़ यूनियन (SMIEU) के युनिअनो का जिक्र करना जरुरी है, जिन्होंने इस क्षेत्र में मजदूरों के सामूहिक संघर्ष की सम्भावना को फिर से खोला है| SPIEU के मजदूरों ने अपने प्रबंधन को चेताया की अगर मारुति सुजुकी चुनाव में धान्द्ली की गयी, तो वे हड़ताल पर चले जायेंगे| आज के गेट मीटिंग में सुजुकी पावरट्रेन के कामरेड अनिल और मोटरसाइकिल के कामरेड अनिल ने फिर से मजदूरों की एकता और सहयोग को मज़बूत करने का आह्वान किया, और इसको पुरे गुडगाँव-मानेसर-धारूहेड़ा-बावल के मजदूरों की एकता बताया|

With the gate meeting in front of the Maruti Suzuki main gate in Manesar in the afternoon at 3pm today, we the Maruti Suzuki Workers Union (MSWU) have reclaimed after two years, what has been rightfully ours. Over 3000 workers attended the gate meeting which was addressed by the new MSWU Union body, including President Pawan Kumar and General Secretary Sanjay Kumar, along with the workers and Union body members from Suzuki Powertrain India Employees Union (SPIEU) and Suzuki Motorcycles India Employees Union (SMIEU). A wave of energy declared that we have ended the regime of fear that was thrust upon us workers by the owners and managers and administrators. With the election and re-formation of our Union on April 4th, today’s meeting is an open declaration of our untiring will to fight against exploitation-repression for all workers.


We have won 11 of 12 seats against the management installed puppet panel in the Union elections on April 4th, with a margin of 80% for most members. Comrade Ramniwas of the Provisional Working Committee of MSWU said that “this victory validates our long continuous untiring struggle of more than two years, against the exploitation-repression by the combined might of the company management-state administration-police and all its tentacles.” This win comes in the wake of not only our long struggle since 4th June 2011 to establish our Union rights and collective power, but also after the unfazed struggle of terminated and jailed workers since 18th July 2012. Since that date, it has been more than 20months, that 147 workers including our entire Union body continue to be in jail, without any bail, in the most severest travesty of justice in the criminal justice system in India. 546 permanent and over 1800 contract workers continue to be terminated from our services even while the legal cases goes on endlessly. The company maliks and managers and the sarkari babus and netas and the entire ruling elite have nakedly united to ‘teach workers a lesson’ for demanding our just rights and for asserting our collective will. Even the courts have punished us for supposedly ‘adversely affecting foreign direct investment’. We only demanded and continue to demand our dignity as workers, our right to form a Union, and the right of contract workers who are worst faced in the situation. In the last two years, we have continued to demand justice and immediate release of all arrested workers and reinstatement of all terminated workers, and a tripartite negotiation to resolve the issue. We only dared to be united to demand this.


For this elections that was due this year, after we formed Maruti Suzuki Workers Union in March 2012 (registration no.1923), the management tried all means to coerce us and install its own puppet Union. It engaged in all manners of conspiracy to divide the workers along lines of permanent and contract, along regions, along various plants, and so on. After it terminated the services if over 2300 workers in July 2012, it hired new workers who were made to toe its line and work in an atmosphere of fear and punishment. They were not allowed to even talk to the terminated workers who were leading the struggle, or even to independent and other trade unions in the area. Recently the management hired 250 new recruits from the Gurgaon plant who they thought would act in their favour, in order to pitch them against the Manesar workers. It tried to disenfranchise the jailed and terminated workers against what is laid down in our Union Constitution, and the pliant labour department had followed suit. It put the police to its use to pick up any worker who would dare to even distribute a parcha. And it propped up candidates for elections who were close to them in one panel and coerced workers to vote for them.


Even against these policies of divide and rule, of repression and threats, we have emerged victorious. With the active support and solidarity of jailed and terminated workers, the struggling workers who stood against the management panel won 11 out of 12 seats. The evening of 4th April was a spirit of recapturing of the factory for workers, as the street in front erupted with celebrations after two years. Workers from inside the plant came with food of the factory canteen for the terminated workers saying that it won’t be long before their struggle also is a win and all arrested workers are also released.


An unprecedented solidarity of workers to the cause of struggle of the last 3 years has made this possible. Solidarity of the workers and Union body of Suzuki Powertrain India Employees Union and Suzuki Motorcycles India Employees Union must especially be mentioned and welcomed, which opens up yet again the possibility of united action by workers in the belt. Union members from nearby Suzuki Powertrain had sent a clear warning to its management against any use of unfair practices in the elections in Maruti Suzuki, on the event of which they would even go for strike. In today’s gate meeting Comrade Anil, President of SPIEU reiterated this unity. Comrade Anil Kumar, president of SMIEU also stressed on strengthening this unity, and making it the unity of workers in the entire industrial belt of Gurgaon-Manesar-Dharuhera-Bawal.

MSWU salutes the struggle and win of Autofit Workers on strike for 59 days!

MSWU congratulates the Spirited Struggle and success of Autofit Workers Union (Dharuhera) after 59 days of strike in defence of their Union rights and rights of contract workers


We salute the spirit of exemplary struggle of workers of Autofit factory, Dharuhera, Haryana in defending their Union rights, achieving a fair settlement, and forging and standing by unity of permanent and contract workers at all costs, and congratulate them on their success. Today in the day-time, on the 59th day of their long-drawn strike since 8th December 2013, they have achieved success and management has been forced to backtrack on their coercive tactics. We also congratulate the Munjal Kiriu workers who won their demands in a negotiation last month after a massive show of unity among workers here, and also justfully got cases registered against management officials who sent goons to beat up workers.


After Autofit Workers Union (Reg. no. 1958) got registered in June 2013 and submitted a charter of demands demanding a fairer wage settlement, the management retaliated at this ‘audacity’ by suspending 17 worker leaders including the whole Union body, and imposed a Good Conduct Bond. It increased repression by continuous harassment and taking back facilities. More suspensions, terminations, good conduct bonds, false criminal cases of misbehaving and stoppage of raw material entry, threats and abuses became the rule. Workers refused to sign the Good Conduct Bond, resisted the move to divide the permanent and contract workers and struck work from 8th December 2013 to effect a complete halt at production, affecting the factory production in Hero Motorcorp and other factories, continued a sit-in at the factory gate, and gave solidarity calls to workers in the region who participated in large numbers. After threats and coercion failed to deter the struggling workers, the management came down to the proposal in the tripartite negotiations on 28th January 2014 in ALC Office Gurgaon, that all contract workers and four Union body members will remain out of the factory, and only permanent workers will be retained. The Autofit Workers Union resisted the move, and continued the struggle with the demand of taking back the contract workers. 28th January was also when MSWU’s Jan jagaran Padayatra (15-31 January 2014 ) had reached Gurgaon, and we were enthused by the joint show of solidarity among workers near the ALC’s office.


Today 5th February 2014, the management has been forced to backtrack on its insistence of terminating the services of striking contract workers, and has agreed in the settlement to take back all the suspended and terminated workers, while only four permanent workers are to be taken back in one month. They have also forced the management to effect a wage settlement with an increase of Rs.7300 in CTC in next three years. This has been possible only because all through the biting winter and wage-less nights of December and January, our worker brothers sat on strike at the factory-gate, and fought tooth and nail to defend their Union rights, and to establish and retain the unity among the permanent, trainee, casual and contract workers. The MSWU also congratulates the striking workers of Munjal KIRIU Manesar who won their demands after 26 days of strike in front of the factory gate through the united might of permanent and contract workers. All workers, contract trainee and permanent were taken back and the management was forced to give in writing that ten permanent would be taken back on duty in a time-bound manner. More than that, it was after many years that the police had to take some action against the guilty management and file an FIR against company three management officials who had sent goons to beat and seriously injure peacefully striking workers at the factory gate two days earlier in an open display of the repression that is the law in the region. This happened when Munjal Kiriu workers along with over 4000 workers of the area gheraoed the Manesar Police Station on 14th December 2014 in the daytime. Management here act as though they are completely immune to the law system. The workers of Autofit and Munjal Kiriu fought the imposition of horrendous working conditions, while the management got away by paying peanuts to workers. They fought the authoritarian and illegal practice of throwing out contract workers every six months. They have fought another instance of company management arrogance, of exploitation of workers toil, divisive policies and repression of legitimate demands. They fought and won today on the strength of their independent fighting spirit, with the solidarity of mass of workers in the region.


This struggle comes in the backdrop of the repressive machinery unleashed on workers’ rights and workers struggles in the industrial belt of Gurgaon-Manesar-Dharuhera-Bawal, particularly after the 18th July 2012 incident in Maruti Suzuki Manesar, which was done first to suppress our own struggle which raised these uncomfortable questions about workers rights, central to which was the issue of contract workers. This struggle has inspired us, and we hope the success of their struggle will inspire all struggling workers and Unions not only in this industrial belt but workers struggling in other parts of India to defend their Union rights, and forge and fight with the combined might of permanent and contract workers. In the coming days, we also hope that workers of Autofit will continue to stand with every voice of struggle of workers in the belt and beyond.
